MANDATORY DISPUTE RESOLUTION: BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

1. BINDING ARBITRATION
You and TuliPest Control Services agree that any and all controversies, disputes, or claims arising out of or relating to these SMS Terms or the Text Message Service shall be resolved through final and binding arbitration, rather than in court. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

2. ARBITRATION PROCEDURES
The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Consumer Arbitration Rules. The AAA's rules are available at www.adr.org. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules.

3. CLASS ACTION WAIVER
YOU AND TULI PEST CONTROL SERVICES LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Tuli Pest Control Services LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
4. SEVERABILITY: If any provision of this Mandatory Dispute Resolution section is found to be unenforceable, that specific provision shall be severed, and the remainder of the arbitration provisions shall be given full force and effect.
